These Terms and Conditions ("Terms") govern your access to and use of seniorguidestl.com and related pages, forms, resources, directories, communications, and services (collectively, the "Site") provided by Senior Guide STL ("Senior Guide STL," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.
1. Purpose of the Site
Senior Guide STL is an independent educational resource and curated community directory designed to help older adults, adult children, caregivers, families, and local professionals navigate later-life transitions throughout Greater St. Louis. The Site may include educational materials, downloadable resources, provider information, directory listings, referral requests, event information, and opportunities for local professionals to apply for participation.
2. Educational information only
Content on the Site is provided for general educational and informational purposes. It is not legal, financial, tax, medical, mental-health, insurance, real-estate, or other professional advice and should not be used as a substitute for advice from a qualified professional who understands your circumstances.
Later-life decisions can involve significant personal, health, legal, and financial consequences. You are responsible for obtaining appropriate professional advice and independently evaluating your options before acting.
3. Directory listings and local professionals
Senior Guide STL may review providers for relevance, professionalism, service area, and alignment with the Site's mission. Inclusion in the directory, a featured placement, participation in educational content, or another appearance on the Site does not constitute a guarantee, certification, fiduciary relationship, or endorsement of any provider's services or outcomes.
Providers are independent third parties and are not employees, agents, partners, or representatives of Senior Guide STL. We do not control their advice, services, fees, licensing, insurance, availability, conduct, or results. You are responsible for independently verifying credentials, licenses, insurance, references, disciplinary history, pricing, contracts, and suitability before engaging a provider.
Any agreement for products or services is solely between you and the applicable provider. Senior Guide STL is not a party to that agreement and is not responsible for disputes, losses, injuries, or damages arising from a provider relationship.
4. Provider applications and participation
Local professionals who submit an application represent that the information provided is accurate, current, and not misleading and that they are authorized to provide it on behalf of the identified organization. Applicants agree to promptly update material information that changes.
Submitting an application does not guarantee acceptance, a directory listing, featured placement, referral volume, exclusivity, or any business result. Senior Guide STL may approve, decline, suspend, edit, categorize, or remove participation or content in its reasonable discretion, subject to any separate written agreement.
Directory listings, sponsorships, featured placements, educational partnerships, events, and other participation opportunities may be subject to additional written terms, fees, editorial standards, or disclosure requirements.
5. Communications and consent
When you submit a form, request information, download a resource, register for an event, or apply as a professional, you authorize us to respond using the contact information you provide. Promotional email or text communications will be sent only as permitted by applicable law and your stated preferences.
If you separately opt in to text messages, message frequency may vary and message and data rates may apply. Consent is not a condition of purchase. Reply STOP to opt out or HELP for assistance.
6. Acceptable use
You agree not to:
- Use the Site for unlawful, fraudulent, deceptive, abusive, or harmful purposes;
- Submit false, misleading, defamatory, infringing, or unauthorized content;
- Impersonate another person or misrepresent your affiliation or qualifications;
- Attempt to gain unauthorized access to the Site or interfere with its security or operation;
- Introduce malware, harmful code, automated scraping, excessive requests, or disruptive technology;
- Copy, republish, sell, or commercially exploit Site content except with written permission; or
- Use directory information for spam, unlawful solicitation, harassment, or data brokerage.
7. Intellectual property
The Site and its original text, design, graphics, branding, guides, directories, compilations, and other content are owned by or licensed to Senior Guide STL and are protected by applicable intellectual-property laws. You may view, download, or print materials for personal, noncommercial use unless otherwise stated. No other rights are granted.
Third-party names, logos, and trademarks belong to their respective owners. Their appearance does not imply ownership by or endorsement of Senior Guide STL.
8. Information and materials you submit
You retain ownership of content you submit. You grant Senior Guide STL a nonexclusive, worldwide, royalty-free license to host, store, reproduce, edit for clarity and format, display, and use submitted content as reasonably necessary to review an application, operate the Site, provide requested services, and—when separately approved—publish a provider profile or educational contribution.
You represent that you have the rights and permissions necessary to submit the content and that our authorized use will not violate another person's rights.
9. Third-party websites and technology
The Site may link to or use third-party websites, platforms, embedded forms, maps, scheduling tools, social networks, and other services. These third parties operate under their own terms and privacy practices. We do not control and are not responsible for their content, availability, security, or conduct.
10. No warranties
To the fullest extent permitted by law, the Site is provided “as is” and “as available.” Senior Guide STL disclaims all express and implied warranties, including warranties of accuracy, completeness, reliability, merchantability, fitness for a particular purpose, title, noninfringement, availability, and security.
We do not warrant that the Site will be uninterrupted or error-free, that information will always be current, or that a resource or provider will meet your needs. Availability, services, credentials, pricing, and other third-party information may change without notice.
11. Limitation of liability
To the fullest extent permitted by law, Senior Guide STL and its owners, contributors, contractors, affiliates, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, revenue, profits, goodwill, or opportunities; or damages arising from decisions made, providers selected, services received, or reliance on Site content.
To the fullest extent permitted by law, our total aggregate liability arising from the Site or these Terms will not exceed the greater of the amount you paid directly to Senior Guide STL for the specific Site service giving rise to the claim during the preceding twelve months or one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.
12. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Senior Guide STL and its owners, contributors, contractors, affiliates, and representatives from claims, liabilities, damages, losses, and reasonable expenses arising from your misuse of the Site, violation of these Terms, infringement of another person's rights, or content you submit.
13. Suspension and termination
We may restrict or terminate access to the Site or participation in the provider network when reasonably necessary to protect users, maintain the integrity of the resource, enforce these Terms, comply with law, or address fraud, misuse, or security concerns.
14. Governing law and venue
These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles. Any dispute not resolved informally will be brought in a court of competent jurisdiction located in St. Louis County, Missouri, unless applicable law requires otherwise.
15. General terms
If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and any applicable written participation agreement, constitute the entire agreement concerning the Site. You may not assign your rights under these Terms without our written consent; we may assign our rights in connection with an organizational change or transfer of the Site.
16. Changes to these Terms
We may update these Terms as the Site, directory, or law evolves. The revised Terms will be posted here with a new “Last updated” date. Continued use after an update means you accept the revised Terms to the extent permitted by law.
